Terms and conditions.
These terms form the agreement between you and Peliqan. They apply to the website and the platform. By opening an account or using the platform, you accept them.

What Peliqan is
Peliqan gives you one complete view of your Private Equity portfolio: positions, valuations, commitments and capital calls. Alongside it, we broker ways to act on what you own: buying or selling positions through secondaries, borrowing against your portfolio with a NAV loan, and financing capital calls.
What Peliqan is not
We are not your investment adviser. The platform gives you information and options; the decisions are yours. Nothing on the website or the platform is an offer or a recommendation to buy or sell any financial instrument. Private Equity involves risk, including the risk of losing what you put in.
Our AFM authorisation
Operating a multilateral trading facility (MTF), a venue where buyers and sellers trade positions directly, requires a licence as an investment firm from the Dutch Authority for the Financial Markets (AFM) under art. 2:96 Wft, together with the detailed requirements that apply to operating one (art. 4:91a et seq. Wft). Peliqan is going through that authorisation process and is building the platform to those requirements. Until the licence is granted we do not hold it and are not under AFM supervision. We don't offer a service before we're authorised to: the portfolio view on the platform is free and needs no licence, and everything else on this website describes what we're building.
Your account
You need an account to use the platform. An account is enough to view your portfolio. We need to know who you are only when you apply for a service, such as buying or selling a secondary or taking out a NAV loan: that is when identity and know-your-customer (KYC) checks happen. If you use the platform for a company or fund, you confirm you are authorised to act for it, and these terms bind it as well as you. Keep your login to yourself, and tell us straight away at info@peliqan.eu if you think someone else has it. You are responsible for what happens under your account.
Using the platform
Use the platform to manage your own portfolio, honestly and within the law. Give us accurate information and keep it current; we build our services on it. Do not probe the platform for weaknesses, overload it or reverse-engineer it, and do not share your access with anyone we have not onboarded.
Transactions
These terms alone never close a transaction. A secondary sale, a NAV loan, a capital call facility: every transaction gets its own agreement, naming your counterparty, its conditions and its costs. You receive, review and sign it before anything is final; no transaction is binding until you sign.
Your data
Our privacy policy sets out how we handle your personal data. We collect what we need to provide the service, do not sell it and do not share it for marketing. We keep records required by law, such as KYC checks, for as long as the law requires.
Ownership
The platform, its design and its content belong to Peliqan. Your data stays yours: the documents you upload and the information about your portfolio. We use it to provide the service and to meet our legal obligations, and for nothing else.
Availability and liability
We work to keep the platform accurate, secure and available, but we cannot promise it is always free of errors or interruptions. Figures such as valuations depend on fund reporting and can lag or change. We are not liable for your investment decisions or the performance of your investments; beyond that, we limit our liability to what Dutch law allows.
Ending your account
You can close your account whenever you want; one message to info@peliqan.eu is enough. We can suspend or close an account that breaks these terms or the law, and we will tell you why unless the law prevents us. Agreements already running, such as a loan, keep their own terms until they end.
Changes to these terms
We update these terms when the platform or the law changes. If a change affects your rights, we tell you before it takes effect; continuing to use the platform means you accept the new version.
If part of these terms falls away
If a court finds one provision invalid, the rest stays standing, and that provision is read as closely to its purpose as the law allows. If Peliqan is sold or merges, these terms move with the business and so do your agreements; we tell you when that happens. Not enforcing something once does not mean we gave up the right to enforce it later.
Governing law
Dutch law applies. Disputes go to the competent court in Amsterdam, unless mandatory law lets you bring them elsewhere. If you have a question or dispute, contact us at info@peliqan.eu.
